ACCESS TO EMERGENCY SERVICES NOT PROVIDED. The DeeditForward Service (as deﬁned below) does not provide a way for you to make emergency calls or other communications to emergency services. If you have an emergency, call 911 with cell phone or land line, or use alternative communications arrangements.
CHECK RESTRICTIONS ON USE. In some regions or countries there may be restrictions on the use of the Service. It is your responsibility to know if you are legally allowed to use DeeditForward in your locale.
Your Agreement With Praxeis and DeeditForward (ALSO “Deed it Forward”) This is an agreement between Praxeis, LLC, a California company (“PRAXEIS”), the owner and operator of www.deeditforward.com (the “DeeditForward Site”), the DeeditForward software (the “DeeditForward Software” – DeeditForward), including the mobile application (the “App”) (collectively, including all content provided by PRAXEIS, the “ DeeditForward Service”, the website deeditforward.com or the “Service”), and you (“you” or “You”), a user of the Service. This agreement is between PRAXEIS AND OR DeeditForward (for the purpose of these terms and conditions, PRAXEIS AND DeeditForward can and shall be used synonymously) and the end user only, and PRAXEIS is solely responsible for the App and its content.
BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE. If you choose to not agree with any of these terms, you may not use the Service. By accepting these Terms of Service, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE REVIEWED THESE TERMS OF SERVICE AND THAT YOU UNDERSTAND THE SAFETY SUGGESTIONS SECTION OF THIS DOCUMENT.
Ability to Accept Terms of Service. You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. If you are under 18 years of age, you are not permitted to use the DeeditForward Service. You further represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a” terrorist- supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. PRAXEIS is the developer of the Service, with an address at 2154 N Lindsay Ct Visalia ca 93291. For more info, email info@Deeditforward.com., or firstname.lastname@example.org.
In order to use certain features of the Service, you must register for an account with DeeditForward (“DeeditForward Account”) and provide certain information about yourself, including in some cases verifiable identification documents, as prompted by the registration form. You represent and warrant that: all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Service does not violate any applicable law or regulation or the terms of this Agreement.
In order to access and use the features of the Service, you acknowledge and agree that you may have to provide DeeditForward with your mobile phone number and other personally identifiable information such as your name, gender, a user name and password, as well as granting DeeditForward access to application content, and for certain features, providing valid identification numbers or uploading official identification documents such as driver license, or identification card. DeeditForward may periodically access your address book or contact list on your mobile phone to locate the mobile phone numbers of other DeeditForward users or non-DeeditForward users for the purposes of current or future services of DeeditForward. Additionally, DeeditForward requires a valid credit card in order to post deed requests, and charges a “connection” fee when a deeder shows up to help. Credit card information is supported by third party entities, and no credit card information is stored by DeeditForward.
You acknowledge and agree that when you use the service (post a deed request for help), your phone location at that time will be determined by geolocation means, and that your general location shall be shown on a map view as a visible map icon representing the general location of your request, thereby your approximate location will be shared with other users. It is the goal of DeeditForward to satisfactorily make your exact location not easily discerned prior to a deed exchange being initiated and you willingly sharing your exact location. However, users shall understand that other users may be able determine your exact location if they are determined, or if your location is a rural or a specific location on a map that makes it obvious of your location (such as the only house on a large expanse of property) . The physical address of your deed request location as a “needer” is only shared with the specific user (“deeder”) that is willing to help you with a good deed, by willingly “sending your location” to the Deeder by in app functionality.
You are solely responsible for the messages/requests that you submit. You must notify DeeditForward immediately of any breach of security or unauthorized use of your mobile phone. Although DeeditForward will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of DeeditForward or others due to such unauthorized use if law dictates.
You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc. or “load testers” such as wget, apache bench, mswebstress, etc., that accesses the Service in a manner that sends more request messages to the DeeditForward servers in a given period of time than a human can reasonably produce in the same period by using a DeeditForward application, and you are forbidden from ripping the content unless specifically allowed. Notwithstanding the foregoing, DeeditForward grants the operators of public search engines permission to use spiders to copy materials from the website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. DeeditForward reserves the right to revoke these exceptions either generally or in specific cases. We do not allow any efforts to reverse-engineer our system, our protocols, or explore outside the boundaries of the normal requests made by DeeditForward clients. We have to disallow using request modiﬁcation tools such as ﬁddler or whisker, or the like or any other such tools activities that are meant to explore or harm, penetrate or test the site. You must secure our permission before you measure, test, health check or otherwise monitor any network equipment, servers or assets hosted on our domain. You agree not to collect or harvest any personally identifiable information, including phone number, from the Service, nor to use the communication systems provided by the Service for any commercial solicitation or spam purposes. You agree not to spam, or solicit for commercial purposes, any users of the Service.
You agree to treat all users with respect and courtesy while using any feature of the App. There is no tolerance for objectionable behavior or posts made as Deed Requests. Additionally, requests that are made should be legitimate requests for help or information that supports the functionality of the app, not comments, or questions, or any subject matter that is considered to be out of the scope of a good deed for you, the user, or a good deed request for the community or others. Determination of objectionable posts shall be made solely by DeeditForward for any reason with no requirement for explanation. Any such posts can be removed and the Users profile responsible can be banned from the App at Praxeis, LLC sole discretion. DeeditForward can not guarantee that users will not be subjected to inappropriate language or pictures in deed requests that could be offensive. Any offensive material encountered can be described and sent to email@example.com.
You agree that all deed requests, responses or actions to Help, as well as any other content you provide or post in connection with DeeditForward will be lawful and respect other people’s rights. Specifically, you agree that you will not: (i) post falsehoods or misrepresentations that could damage DeeditForward or any third party; (ii) submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, request help that would be considered dangerous to person or property, or is otherwise inappropriate; (iv) post advertisements or solicitations of business; (v) impersonate another person.
In order to maintain the integrity of the DeeditForward apps, DeeditForward reserves the right to remove any Request for Help, or ban any user (“DEEDER” AND/OR “NEEDER“, ) that DeeditForward feels is damaging to its platform in any way without any notice. This can include repeated requests; repeated attempts (as a DEEDER) to engage or to help a user (NEEDER) after being denied or cancelled, responses to help that are misleading; requests for help which are ambiguous or might be perceived as inappropriate by certain users ; or out of scope, etc. Additionally, DeeditForward reserves the right to verify user identity based on provided information by the user on it’s own terms and internal criteria, and failure to be satisfactorily verified is justifiable reason to deny access or use of the service. DeeditForward is under no obligation to give a user a reason for denied access.
These Terms of Service apply to all users of the DeeditForward Service. Information provided by our users through the DeeditForward Service may contain links to third party websites that are not owned or controlled by DeeditForward. DeeditForward has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, DeeditForward will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that DeeditForward shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website.
Intellectual Property Rights & Scope of License
IN THE EVENT OF ANY THIRD PARTY CLAIM THAT THE APP AFTER ITS LAUNCH, AND/OR THE END USER’S POSSESSION AND USE OF THE APP, INFRINGES THAT THIRD PARTY’S INTELLECTUAL PROPERTY RIGHTS, THEN DeeditForward, NOT APPLE OR ANY OTHER PUBLISHER, WILL BE SOLEY RESPONSIBLE FOR THE INVESTIGATION, DEFENSE, SETTLEMENT, AND DISCHARGE OF ANY SUCH SUCH INTELLECTUAL PROPERTY INFRINGEMENT CLAIM. SIMILARLY, DeeditForward IS SOLELY RESPONSIBLE FOR ADDRESSING ANY CLAIMS OF THE END USER OR ANY THIRD PARTY RELATING TO THE APP, INCLUDING BUT NOT LIMITED TO: (I) PRODUCT LIABILITY CLAIMS; (II) ANY CLAIM THAT THE APP FAILS TO CONFORM TO ANY APPLICABLE LEGAL OR REGULATORY REQUIREMENT; AND (III) CLAIMS ARISING UNDER CONSUMER PROTECTION OR SIMILAR LEGISLATION.
This License is a limited, non-exclusive, non-transferable, non-sub-licensable license to use the Service on any mobile device or personal computer that you own or control. You may not distribute or make the Service available over a network where it could be used by multiple mobile devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Service.
SAFETY: GENERAL DISLCAIMER- EXTENT OF SERVICES
By using the DeeditForward apps service as a user (“needer” and/or “deeder”), you acknowledge that the DeeditForward service is ONLY meant as a connection service, such as the likes of a “Craigs List” or a community bulletin board provided in app form. Any activity or result from any activity of the connection service provided by DeeditForward, including the “good deed” itself, beyond this connection service is at will, and the sole responsibility and liability of the users. Despite any identity verification claim or safety features provided currently or in the future by DeeditForward, users shall consider all other users strangers, and shall take appropriate measures to ensure personal safety accordingly and to the extent that they consider adequate for their own risk tolerance. When using the DeeditForward app, Users agree to take the risks involved in helping a stranger or asking and receiving help from a stranger. Being as safe as possible while using the app might entail always having a working phone with service with you and telling a friend or family member what your are doing and where you are going, when you are planning to return; that you are requesting help or offering help with the app, and that someone is coming to help you; or that you are going to help someone. Safety for your risk tolerance may mean having a friend with you, and to “exchange” good deeds only in public places with or in the company of others. All users shall use the DeeditForward service in good will, and shall behave with safety, and respect for their fellow man at all times. People who do not feel comfortable or safe with the features of the app, or the real risks involved when meeting strangers should not use it.
Needer (Needer side of the app) User “Deed Requests” – Asking for Help
The DeeditForward Service allows DeeditForward users (“needers”) to request help (A GOOD DEED) by submitting text, photos and other communications, (collectively, the “deed Requests”). These Requests may be hosted, shared, and/or published as part of the DeeditForward Service, and will be visible to other users of the Service. By default, users of DeeditForward app, within a defined radius of the request for a good deed and users who search your area, will see or be made aware of your “deed Request” and that request shall stay in queue for a predetermined limited time (Additionally it is possible for “Deeders” to search any area of the map in the world for posted Deed requests). Once a request for help is “accepted” by the needer sending their exact location, a deeder is shared the exact location (including turn by turn map directions) and then arrives to help. A notification of arrival is prompted by the deeder, and once the good deed help has been completed or attempted, a user will be prompted to rate, and an option to of donating to a Deeder specified cause or charity may be offered by variable means, including links to third party apps such as “Gofundme”. A donation is not required because a good deed is done for free without expectation of compensation, however you may choose donate in appreciation, or options may be given to donate to a charity of your or the deeders choice. Recently completed and non-completed requests may be stored by the DeeditForward app. When no charitable cause is specified by the “deeder” in the DeeditForward app, a user may see a “campaign” or “cause” soliciting donations to the DeeditForward company itself as a default landing page if none is entered by the user.
For your privacy, it is important that you refrain from submitting or posting messages with personal information (such as last name or address) or photos that you don’t want to be seen or made pubic in the DeeditForward user community or beyond. Other users can only see information about you that you willingly and knowingly include in a request for help. If you confirm that you still want help after the app notifies you that help is being offered by a “deeder”, and after you the opportunity to review the deeders rating, name and and profile picture; and communicate by text messaging, only then will your exact location be shared with that particular user (“deeder”) only. Last names are not required to be shared or displayed for user names, and are discouraged during both the sign-in and subsequently when using the app.
As clarified in the following section, you retain your ownership rights in your Deed Requests. You understand that whether or not such Deed Requests are published, DeeditForward does not guarantee any confidentiality with respect to any submissions. Additionally, by using the app you also agree that the DeeditForward service is solely a connection service, and that any and all activity or consequence resulting from the connection made through the app is the sole responsibility of the users, and users shall indemnify and hold both PRAXEIS and other users, harmless to the fullest extent allowed by law.
You shall be solely responsible for your own Deed Requests and the consequences of posting or publishing them. Because DeeditForward is only acting as a connection service and repository of data, user-submitted Help Requests do not represent the views or opinions of DeeditForward, and DeeditForward makes no guarantees as to the validity, accuracy or legal status of any requests. In connection with Help Requests, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize DeeditForward to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Help Requests to enable inclusion and use of the Help Requests in the manner contemplated by the Service and these Terms of Service; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Deed Request to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the deed Requests in the manner contemplated by the Service and these Terms of Service. To be clear: you retain all of your ownership rights in your Deed Requests, but you have to have the rights in the first place. However, by submitting the Deed Requests to DeeditForward, you hereby grant DeeditForward a worldwide, non-exclusive, royalty-free, sub-licenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the deed Requests in connection with the DeeditForward Service and DeeditForward’s (and its successor’s) business, including without limitation for promoting and redistributing part or all of the DeeditForward Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your status on the DeeditForward Service a non-exclusive license to access your deed Requests through the Service. The foregoing license granted by you terminates once you remove or delete a deed Request from the DeeditForward Service. DeeditForward reserves the right to discontinue any aspect of the DeeditForward Service at any time.
In connection with deed Requests, you further agree that you will not: (i) publish falsehoods or misrepresentations that could damage DeeditForward or any third party or property; (ii) submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) post advertisements or solicitations of business; (v) impersonate another person; (vi) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs; (vii) interfere with or disrupt the integrity or performance of the Service or the data contained therein; or (viii) attempt to gain unauthorized access to the Service or its related systems or networks.
Deed Requests (Posts)
DeeditForward does not endorse any Deed Request or any opinion, recommendation, or advice expressed therein unless specified, and DeeditForward will make every effort to remove all content anddeed Requests if properly notified that such content or Help Request infringes on another’s intellectual property rights. If you believe that material or content residing on or accessible through the Service infringes a copyright, please send a notice of copyright infringement containing the following information to info@Deeditforward.com.
A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed; Identification of works or materials being infringed;
Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence; Contact information about the copyright owner including address, telephone number and, if available, e-mail address. If you are not the owner of the copyright that has been allegedly infringed, please describe your relationship to the copyright owner; A statement that you have a good faith belief that the material is not authorized by the copyright owner, its agent, or the law; and A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.
It is our policy:to remove or disable access to the infringing material; to notify the content provider, member or user that it has removed or disabled access to the material; and that repeat offenders will have the infringing material removed from the system and that we will terminate such content provider’s, member’s or user’s access to the Service.
You understand that when using the DeeditForward Service you will be exposed to Requests from a variety of sources, and that DeeditForward is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such deed Requests, and that such Requests are not the responsibility of DeeditForward. DeeditForward is not responsible for the conduct of any User. You further understand and acknowledge that you may be exposed to Deed Requests that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against DeeditForward with respect thereto, and agree to indemnify and hold DeeditForward, its officers, directors, employees, agents, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the DeeditForward Service as further set forth in the indemnity section below.
Additionally, you also agree to indemnify and hold the user (“deeder”)who offers help, harmless to the fullest extent allowed by law regarding the performance of attempting to help during the course of providing what the DeeditForward app refers to as a “good deed”, and that you shall not post requests for help that are illegal in your jurisdiction, may be dangerous or cause physical harm to the “deeder”, to you the user (“needer”), or others; or cause damage to private property.
Deeder (“deeder side of the app”) – Helping Others
The DeeditForward Service allows DeeditForward app users (“deeders”) to offer help (A Good Deed) to users requesting help (“needers”) with the DeeditForward app (collectively, the “good Deed or deed Requests” or community requests). By default, users of the DeeditForward app, between a variable or default proximity of the request for a good deed, will see all active (non- expired) deed Requests. A deeder may also freely move about the geolocation map and see requests for help anywhere in the world. Once an offer of help is offered messaging will be enabled with the user that posted the request. After review of available profile information of the deeder and after communication, a user accepts help by “sending their exact location”, and a needer’s exact location will then be shared with the deeder. You shall then agree as a “deeder” to make a best effort to arrive at the user location and make an honest attempt to help the “needer” and to notify through the DeeditForward app of progress as prompted in the app. Recently completed and non-completed requests may be stored by the DeeditForward app for safety purposes and for data to better improve services.
You are solely responsible to determine your capability to help the user based on the description of the deed request and any subsequent communications with the user (“needer”). The feasibility of providing help to user (“needers”), the safety of giving such help, and any danger of performing such help is a your sole responsibility as a deeder. You further agree by using the service that you shall not perform a good deed that is illegal, or will put yourself in risk of injury or endanger yourself, the user (“needer”) or others, or private party. You further understand and acknowledge that by using the service, you hereby do waive, any legal or equitable rights or remedies you have or may have against DeeditForward with respect to the performance of a good deed, and agree to indemnify and hold DeeditForward, its officers, directors, employees, agents, affiliates, and/ or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the DeeditForward Service. Additionally, you also agree to indemnify and hold the user who requests help, harmless to the fullest extent allowed by law regarding the performance of a good deed by you for the user.
You understand that when using the DeeditForward Service you will be exposed to Deed/Help Requests from a variety of sources, and that DeeditForward is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Requests, and that such Requests are not the responsibility of DeeditForward. DeeditForward is not responsible for the conduct of any User. You further understand and acknowledge that you may be exposed to Requests that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against DeeditForward with respect thereto, and agree to indemnify and hold DeeditForward, its officers, directors, employees, agents, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the DeeditForward Service.
You understand that by using the DeeditForward Service, you agree to not circumvent the app, use the service or information from or within the app to find people to help outside of the DeeditForward app itself, nor determine a users exact location by means outside of the app service itself. The app is purposeful in its limits of geolocation map zooming so that a users exact location is not easily discernable. You agree not to contact or try to find another user without their consent as provided in the DeeditForward app services. You further agree that you shall not use the geolocation service of the app to triangulate or use any other method to determine exact locations of persons who post a deed request for any purpose.
The DeeditForward apps are intended only to connect people who are willing to exchange of good deeds. By using the DeeditForward app, you agree that you are providing good deeds of your own free will, without expectation of compensation, monetary or otherwise. You shall not act in a way that would imply that you should be compensated, nor shall you directly ask for compensations, or tips, of a user whom for you have helped through the app service. You will be given the opportunity to link a cause of your choice, through a third party, such as “Gofundme”, a campaign (or charity) that will be shared with a needer you have helped through the app once you have completed or faithfully attempted to complete a good deed.
Users (“needers”) are prompted to rate you after you have attempted or completed a good deed and the app has been prompted of a completed deed. Ratings under a threshold (2 stars or less out of 5 for example) may require a request for additional information. Deeders who receive bad ratings, or act inappropriately as determined by PRAXEIS,LLC are subject to have their access to DeeditForward suspended or revoked, without notice. Inquiries after an account has been canceled can be sent to firstname.lastname@example.org. For safety and privacy of all users, Praxeis, LLC is not obligated to respond or share reasons for cancellations. By using the DeeditForward app, you agree that your personal information as provided by you when you signed up, including photo, name, and current star rating will be shared with a needer that you agree to help. Additionally, you also agree to indemnify and hold the user who requests help, harmless to the fullest extent allowed by law; and that you shall not offer or perform help that will be dangerous or cause physical harm to the “deeder”, to you the user (“needer”), or others; or cause damage to private property. Only share information that you are willing to be public. If an offer by yourself as a deeder to help someone is rejected, you shall not attempt to offer help that same deed request again if it is re-posted, or “stalk” that user by continuously offering help for a request you have been previously denied or been disconnected from. by the user
Other Users and User Content
As referenced above, each user of the Service is solely responsible for any and all their user content posted (“User Content”). Because we do not control User Content, you acknowledge and agree that we are not responsible for any User Content and we make no guarantees regarding the accuracy, currency, suitability, or quality of any User Content. Your interactions with other Service users are solely between you and such user. You agree that DeeditForward will not be responsible for any loss or damage incurred as the result of any such interactions. If there is a dispute between you and any Service user, we are under no obligation to become involved. For purposes hereof, “User Content” means any photographs, pictures, content, help reviews, text, artwork, files, programs, sound, graphics, video, data, product ratings, product comments, and other similar materials that a user submits, e-mails or otherwise uses with the Services. “Your User Content” means User Content that you provide to DeeditForward. “Media” means any means of conveying information, whether now known or hereafter devised. You are solely responsible for your User Content. You assume all risks associated with use of User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of Your User Content that makes you or any third party personally identifiable.
By using Your User Content with the Services, you automatically grant, and you represent and warrant that you have the right to grant, to DeeditForward an irrevocable, nonexclusive, royalty-free and fully paid, worldwide license to reproduce, distribute, publicly display and perform your User Content, and to grant sublicenses of the foregoing, solely for the purposes of including Your ser Content in the Services. You agree to irrevocably waive (and cause to be waived) any claims and assertions of moral rights or attribution with respect to Your User Content.
SAFETY & SECURITY
THE SAFETY AND SECURITY OF OUR USERS IS OF UTMOST IMPORTANCE TO DeeditForward. THE FOLLOWING GUIDELINES ARE SUGGESTIONS THAT CAN BE FOLLOWED TO ENSURE YOUR SAFETY WHILE USING DeeditForward. WE CANNOT POSSIBLY LIST ALL SAFETY PRECAUTIONS SO DeeditForward DOES NOT REPRESENT THIS LIST TO BE COMPLETE.
Financial Information. You should Ignore any requests to send money, even if a User claims to be in an emergency situation; we ask you report such incidents to us immediately. Additionally, do not provide any financial information to any User, such as bank account information, a social security number, credit card number, and similar financial information under any circumstance.
Personal Information. Do not provide detailed information about yourself. You should not provide home addresses, phone numbers, full names, and similar information to other Users that you have not reviewed and agreed to allow access to such information. Personal information beyond first name and address are not recommended to ever be shared with other users.
Meeting in Person. You are in total control of your experience on DeeditForward. Keep in mind that DeeditForward is open for use to anyone over 18 years of age, and DeeditForward may not do anything beyond a cursory identity verification check that information was entered as requested, OR it may do none at all. DeeditForward makes every feasible available effort to create a safe “good deed” exchange environment, but there is also no way to ensure that any identity verification system or rating system is entirely accurate, or ensure safety for all users, or guarantee identity for those who wish to purposefully misrepresent themselves. Therefore, please exercise appropriate caution before meeting anyone in person through the app. If you choose to meet a DeeditForward User either by the offering of help, or the request for help, you take all responsibility for that interaction as if it was a stranger whom you were offering help to, or asking help from.
DeeditForward is solely a connection service. Being safe would be to always have working phone with service with you and tell a friend or family member what your are doing and where you are going, when you plan to return; that you are requesting help or offering help, and that someone is coming to help you; that you are going to help someone and have a friend with you, and to “exchange” good deeds only in public places with others around or with friends. All users shall use the DeeditForward service in good will, and shall behave with safety, and respect for their fellow man at all times. (This is after all the goal of DeeditForward, to create connections within communities between people who were formerly strangers by the exchange of good deeds and helping each other. ) Ignore any user help request, or offer to help, that sounds suspicious and report it immediately to info@DeeditForward.com.
Report Suspicious Users and Scammers. Please report anyone you think is violating our Terms of Service. Examples of such violations would include people asking for donations or money; anyone who looks under the age of 16; anyone sending harassing or offensive messages; Users behaving inappropriately via texts or in person; profiles which appear fabricated or fraudulent; spam or solicitations, such as attempts to sell products or services; or Users that ask you for your address under the pretense of sending flowers or gifts. Similarly, be wary of third party websites.
WARRANTY, MAINTENANCE, LIMITATION OF LIABILITY, INDEMNITY

DeeditForward MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE’S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONSIN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE DeeditForward SERVICE. DeeditForward DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE DeeditForward SERVICE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER HELP REQUEST OR OTHER ADVERTISING, AND DeeditForward WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
DeeditForward IS SOLELY RESPONSIBLE FOR ANY PRODUCT WARRANTIES, WHETHER EXPRESS OR IMPLIED BY LAW. APPLE HAS NO WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO THE APP AND IS IN NO WAY RESPONSIBLE FOR ANY CLAIMS, LOSSES, LIABILITIES, DAMAGES OR COSTS.
Maintenance and Support
DeeditForward IS SOLELY RESPONSIBLE FOR PROVIDING ANY MAINTENANCE AND SUPPORT SERVICES WITH RESPECT TO THE APP AS REQUIRED UNDER APPLICABLE LAW. APPLE HAS NO OBLIGATION TO FURNISH ANY MAINTENANCE AND SUPPORT SERVICES WITH REGARD TO THE APP LICENSE.
Limitation of Liability
YOU SPECIFICALLY ACKNOWLEDGE THAT DeeditForward SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
The Service is controlled and offered by DeeditForward from its facilities in the United States of America. DeeditForward makes no representations that the DeeditForward Service is appropriate or available for use in other locations. Those who access or use the DeeditForward Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.
Export of the App
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported (a) into any U.S. embargoed countries or to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List. By using the App, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of nuclear, missiles, or chemical or biological weapons.
You agree to defend, indemnify and hold harmless DeeditForward, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the DeeditForward Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Help Requests caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the DeeditForward Service.
In no event shall DeeditForward, its affiliates or its partners be liable (directly or indirectly) for any losses or damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the Services including, without limitation, death, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other Users or persons you meet through the Service. You agree to take all necessary precautions in all interactions with other Users, particularly if you decide to communicate off the Service or meet in person, or if you decide to send money to another user. In addition, you agree to review and follow the Company’s Safety Tips prior to using the Service

DeeditForward respects the intellectual property rights of others and expects users of the Site to do the same. At DeeditForward’s discretion and in appropriate circumstances, DeeditForward may terminate the accounts of users or prevent access to the Site by users who infringe the intellectual property rights of others. DeeditForward may access, preserve and disclose to third parties any of your information or data (including personally identifiable information and private communications) related to a written complaint of copyright infringement if DeeditForward believe in its sole discretion that such access, preservation, or disclosure is necessary or useful to respond or otherwise address such complaint. Such Third Party Sites & Ads are not under the control of DeeditForward and DeeditForward (Praxeis,LLC) is not responsible for any Third Party Sites & Ads, including credit card processing provided in app through services such as STRIPE. DeeditForward does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third Party Sites & Ads. Advertisements and other information provided by Third Party Sites & Ads may not be wholly accurate. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. When you link to a Third Party Site, the applicable service provider’s terms and policies, including privacy and data gathering practices govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any third party. Your transactions and other dealings with Third Party Sites & Ads that are found on or through the Site, the Apps or the Services, including payment and delivery of related goods or services, are solely between you and such merchant or advertiser.
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by DeeditForward without restriction.
The failure of DeeditForward to enforce any right or provision of these Terms of Service will not be deemed a waiver of such right or provision.
This Agreement shall be governed by the laws of the State of California without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. Your use of the App may also be subject to other local, state, national, or international laws. Notwithstanding the foregoing, we may seek injunctive or other equitable relief to protect our intellectual property rights in any court of competent jurisdiction.
